Kraken Terms of Service

Agreement to Terms

By accessing or using Kraken's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use our platform. These terms constitute a legally binding agreement between you and Payward, Inc. d/b/a Kraken.

Eligibility

To use Kraken, you must be at least 18 years of age and have the legal capacity to enter into binding agreements. You must not be located in a jurisdiction where cryptocurrency trading is prohibited. You must complete identity verification and comply with all applicable laws and regulations.

Account Responsibilities

You are responsible for maintaining the security of your account credentials and two-factor authentication devices. You agree to notify Kraken immediately of any unauthorised access. You are the sole authorised user of your account and may not share access with any other person or entity.

Trading Services

Kraken provides a platform for buying, selling, and trading digital assets. All trades are executed on a principal-to-principal basis between users. Kraken does not provide investment advice or recommendations. Trading cryptocurrency carries substantial risk, and you may lose your entire investment.

Fees

Kraken charges fees for trading, deposits, and withdrawals as published on our fee schedule. Fees may be updated from time to time with notice to users. You agree to pay all applicable fees for transactions executed on your account.

Risk Disclosure

Cryptocurrency trading involves significant risk. Prices are highly volatile and can result in substantial financial losses. Leveraged trading amplifies both potential gains and losses. Past performance does not indicate future results. You should not trade with funds you cannot afford to lose.

Prohibited Activities

You agree not to use Kraken for money laundering, terrorist financing, fraud, market manipulation, or any other illegal activity. Kraken reserves the right to suspend or terminate accounts engaged in prohibited activities and to report such activities to appropriate authorities.

Intellectual Property

All content, trademarks, logos, and software on the Kraken platform are the property of Payward, Inc. or its licensors. You may not copy, modify, or distribute any Kraken content without prior written permission.

Limitation of Liability

Kraken's liability is limited to the maximum extent permitted by applicable law. Kraken is not liable for losses resulting from market volatility, technical failures beyond our reasonable control, or your failure to secure your account credentials.

Dispute Resolution

Any disputes arising from these terms will be resolved through binding arbitration. You agree to waive your right to participate in class action lawsuits. These terms are governed by the laws of the state of California, United States.

Modifications

Kraken may modify these terms at any time. Material changes will be communicated with 30 days advance notice. Continued use of the platform after changes take effect constitutes your acceptance of the modified terms.
